Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website at linguacarpathia.com (the "Site") and the translation, localisation and interpreting services (the "Services") provided by Lingua Carpathia LLC, 14 Prospekt Svobody, Lviv 79008, Ukraine ("Lingua Carpathia", "we", "us").
By accessing the Site or engaging our Services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or engage our Services.
1. Acceptance of these Terms
You accept these Terms by (a) using or browsing the Site, (b) submitting a project enquiry or request for quotation, or (c) entering into a service agreement or placing an order with Lingua Carpathia. If you are acting on behalf of a company or other legal entity, you represent that you have authority to bind that entity.
2. Description of services
Lingua Carpathia provides the following services:
- Written translation (certified and non-certified) across 40+ language pairs.
- Software, website and product localisation.
- Technical, legal, medical and marketing translation.
- Transcreation (creative adaptation of marketing and advertising content).
- Simultaneous and consecutive interpreting, in person and by remote video/telephone.
- Document review and editing of existing translations.
The specific scope, deliverables, language pair, word count, timeline and price for each project are agreed in writing (email or signed quote/order form) before work begins. These Terms apply to all such projects unless superseded by a separate written agreement signed by an authorised representative of Lingua Carpathia.
3. Orders and payment
3.1 Quotations
All quotations are valid for five (5) business days from the date of issue unless otherwise stated. A quote is not a binding contract until accepted by the client in writing and confirmed by Lingua Carpathia.
3.2 Payment terms
Unless agreed otherwise in writing, payment is due within 14 calendar days of the invoice date. For new clients and projects above a certain value, we may require a deposit of up to 50% before work begins. We reserve the right to withhold delivery of completed translations until payment is received in full.
3.3 Cancellations
If you cancel a confirmed project after work has begun, you are liable for the cost of the work completed up to the point of cancellation, plus any expenses incurred. Cancellation must be made in writing.
4. Source materials and client responsibilities
You are responsible for ensuring that:
- Source documents are complete, legible and in the format agreed.
- You have the right to share any documents you provide for translation (e.g. no third-party copyright is infringed).
- You provide any terminology lists, style guides, glossaries or reference materials available, which will improve the quality of the translation.
- Contact information you supply is accurate and up to date.
Lingua Carpathia is not liable for errors arising from illegible, incomplete or incorrectly supplied source materials.
5. Delivery and acceptance
Agreed delivery dates are provided in good faith. Lingua Carpathia will notify you promptly if circumstances beyond our control (e.g. force majeure, illness of key specialists) may affect a deadline and will propose revised arrangements. Upon delivery, you have five (5) business days to review the translation and raise any objections in writing. After this period the translation is deemed accepted unless objections have been raised.
6. Quality and revisions
We are committed to accuracy and quality. If a delivered translation contains errors attributable to Lingua Carpathia that depart from the agreed specifications, we will correct them free of charge within a reasonable time. Revision requests must be submitted in writing within 30 days of delivery and must specify the alleged errors with reference to the source text.
Changes resulting from revised or updated source material, changed requirements, or matters of stylistic preference (rather than error) may be treated as new work and quoted accordingly.
7. Intellectual property
Upon receipt of full payment, all intellectual property rights in the completed translation are assigned to you. Until payment is received in full, all rights in the translation remain with Lingua Carpathia. Source materials remain your property at all times. Lingua Carpathia retains the right to use anonymised excerpts of work for quality benchmarking and staff training purposes, unless you have requested otherwise in writing.
8. Confidentiality
Lingua Carpathia treats all client documents and project details as strictly confidential. We will not disclose your materials or any confidential information about your business to any third party except as necessary to deliver the service (e.g. a specialist freelance translator under NDA) or as required by law. We are happy to sign a separate NDA prior to project commencement if you require it.
9. Acceptable use of the Site
You agree not to:
- Use the Site for any unlawful purpose or in violation of any applicable laws or regulations.
- Attempt to gain unauthorised access to the Site, its server, or any system or network connected to it.
- Transmit any harmful, offensive or disruptive content through the Site's contact form or other communication channels.
- Use automated tools, bots or scrapers to access or extract data from the Site without our prior written consent.
10. Disclaimers
The Site and its content are provided "as is" and "as available". We make no warranties, express or implied, regarding the completeness, accuracy or fitness for a particular purpose of the information on the Site. We do not warrant that the Site will be uninterrupted or error-free.
Translations are prepared with professional care and skill; however, Lingua Carpathia does not guarantee that a translation will be accepted by any specific authority, institution or third party, as acceptance criteria are outside our control.
11. Limitation of liability
To the fullest extent permitted by Ukrainian law, Lingua Carpathia's total liability to you for any claim arising from these Terms or any project shall not exceed the fees paid by you for the specific project giving rise to the claim. We are not liable for any indirect, consequential, incidental or special damages, including loss of profit, loss of data or reputational damage, even if advised of the possibility of such damages.
12. Links to third-party websites
The Site may contain links to third-party websites for reference or convenience. These links do not constitute endorsement of those sites or their content. Lingua Carpathia has no control over and accepts no responsibility for third-party websites.
13. Governing law and disputes
These Terms are governed by and construed in accordance with the laws of Ukraine. Any dispute arising from or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the competent courts of Lviv, Ukraine. Before initiating formal proceedings, both parties agree to attempt to resolve disputes in good faith through direct negotiation.
14. Changes to these Terms
We reserve the right to update these Terms at any time. Updated Terms will be posted on this page with a revised "Last updated" date. Continued use of the Site or our Services after changes take effect constitutes acceptance of the revised Terms. Where changes are material, we will provide reasonable notice on the Site.
